This website is operated by Little Acre Gourmet Mushrooms. Throughout the site, the terms “we”, “us” and “our” refer to Little Acre Gourmet Mushrooms. Little Acre Gourmet Mushrooms offers this website, including all information, tools and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated here.

By visiting our site and/ or purchasing something from us, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”), including those additional terms and conditions and policies referenced herein and/or available by hyperlink. These Terms of Service apply to all users of the site, including without limitation users who are browsers, vendors, customers, merchants, and/ or contributors of content.

Please read these Terms of Service carefully before accessing or using our website. By accessing or using any part of the site, you agree to be bound by these Terms of Service. If you do not agree to all the terms and conditions of this agreement, then you may not access the website or use any services. If these Terms of Service are considered an offer, acceptance is expressly limited to these Terms of Service.

Any new features or tools which are added to the current store shall also be subject to the Terms of Service. You can review the most current version of the Terms of Service at any time on this page. We reserve the right to update, change or replace any part of these Terms of Service by posting updates and/or changes to our website. It is your responsibility to check this page periodically for changes. Your continued use of or access to the website following the posting of any changes constitutes acceptance of those changes.

RETURN POLICY

We hope you enjoy all products purchased at littleacre.com.au, but understand that sometimes returns and refunds are necessary. If we shipped you the wrong product, or your order arrived damaged we're sorry! We will send a replacement or refund you for your purchase. Please email within 14 days of receiving your order for a replacement or refund. Excluding items described in the Terms below, if you ordered the wrong item, or simply changed your mind we will refund you for your purchase (minus the shipping charges), provided the returned item(s) are received back in their original packaging and in new condition. When your return is received, you will be issued a refund to your credit card. You will be responsible for return shipping costs of non-defective merchandise.

Mushroom spawn returns and refunds

We do not offer returns or refunds for mushroom spawn purchases made via The Culture Club online store.

Grain spawn is sent via Express Post using Australia Post. Upon receipt, place your spawn in the fridge until you're ready to use it (please note Pink Oyster can not be stored in the fridge and needs to be used soon after receiving it). If you refrigerate spawn, take it out of the fridge and leave out at room temperature for 24 hours.

Grow Kit returns and refunds

All our Oyster Mushroom Grow Kits come with our Guaranteed to Grow promise, meaning if your kit doesn't grow any mushrooms, we'll replace it free of charge. If you see no activity after following the instructions after two weeks, send us an email with photographs to hello@littleacre.com.au. We will offer troubleshooting advice to help grow your mushrooms. If your Grow Kit does not produce with our help, we will send a free replacement Grow Kit.  

Orders

Orders cut-off 24 hours before the next delivery window. For example, if you order on a Monday at 2pm, the next available delivery window for your order will be on Friday.

We may at any time prior to the Delivery Date reject any order placed by you or on your behalf if:(i) we form the opinion that we do not have the resources, or adequate resources, including but not limited to labour, stock or available time, to satisfy your order;(ii) we form the opinion that we cannot comply with any requirements stipulated as part of your order;(iii) your payment fails to be processed. If certain Products are not available on a delivery day we will substitute all or part of your order with another available Product.

Resale of fresh mushrooms purchased through our Farm to Door delivery service is explicitly prohibited.

Delivery of goods

You are liable for the goods once they are delivered to you or they are left at your address as per your instructions.

Any Products ordered shall be deemed to have been duly delivered to you upon them being left at the address stated in the order details or at such other address nominated in your order, regardless of:(a) whether or not such place is attended at the time of such delivery; and(b) whether or not delivery is acknowledged or otherwise accepted by you or on your behalf at the relevant time.

FARM-TO-DOOR DELIVERY SERVICE

Acceptance of goods

Any objection to the quantity, quality, fitness for purpose, correspondence with description or correspondence with sample of any Products supplied by or on behalf of us must be notified in writing by you to us within three days of delivery, failing which you hereby agree that such Goods shall be deemed to be:(a) reasonably fit for their purpose, or for any specific purpose previously communicated to us;(b) of sound quality;(c) without defect;(d) correct in quantity; and(e) consistent with any sample or description by reference to which they were supplied.

Cancellations

One time purchases may be cancelled up to 48 hours before arranged delivery without incurring any cancellation fees and a refund may be arranged.

Subscriptions are set for a minimum of three deliveries, you may cancel anytime but if it is before your third delivery you will still be charged for three deliveries. These deliveries can be set as weekly, fortnightly or monthly. After your third delivery, you may cancel at any time without incurring cancellation fees.

To manage your details, skip a delivery, or cancel your subscription, log in to the Customer Portal via your subscription activation email or contact us at any time.

Liability and indemnities

Although we will endeavour to ensure that all Products supplied by us satisfy your requirements, no Liability is accepted by us, and to the fullest extent permitted by law all Liability is excluded, for any Loss arising from:(i) any failure or delay in performance of any of our Obligations to you, under these Terms or otherwise, arising from any cause beyond its reasonable control;(ii) any failure by us to deliver Products which are (a) without defect, (b) correct in quantity, or (c) consistent with any sample or description by reference to which they were supplied;(iii) any personal injury or death to any consumer of any Products.

Prices for our products are subject to change without notice.

We reserve the right at any time to modify or discontinue the Service (or any part or content thereof) without notice at any time.

We shall not be liable to you or to any third-party for any modification, price change, suspension or discontinuance of the Service.

MODIFICATIONS TO THE SERVICE AND PRICING

Subject to any law to the contrary, we do not guarantee that Products will appear exactly as they do in any photograph on any website, brochure or social media post published by us or on our behalf.

You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service, use of the Service, or access to the Service or any content on the website through which the service is provided, without express written permission by us.

GENERAL
